This Privacy Policy describes how your personal information is collected, used, and shared when you visit or make a purchase from www.calgarygallery.co.uk (the “Site”), in addition to data gathered in our store; Calgary Gallery, Calgary, Isle of Mull, PA75 6QQ, United Kingdom (the
“Store”).

Our Privacy Policy is designed to comply with all relevant legislation, including the GDPR.
Philippa Garrard is the owner of Calgary Gallery, is the data controller of the personal information we hold about you.

PERSONAL INFORMATION WE COLLECT

- DEVICE INFORMATION
When you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device.
Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site.
We refer to this automatically-collected information as “Device Information.”
We collect Device Information using the following technologies:
- “Cookies” are data files that are placed on your device or computer and often include an

- “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps.

- ORDER INFORMATION
When you make a purchase or attempt to make a purchase through the Site or the Store, we collect certain information from you, including your name, billing address, shipping address, payment information (including credit card numbers, PayPal, Apple Pay and/or Google Pay), email address, and phone number. We refer to this information as “Order Information.”


- MARKETING INFORMATION:
When you sign up for marketing communications and updates through our online sign-up form, during checkout process or when you opt for an e-reciept, we collect your email address and name. We refer to this as 'Marketing Information'.
By signing up to marketing communications you accept our Privacy Policy and Terms and Conditions and you choose to receive updates on exciting new product launches, Store
information, sales and offers. We may also track information and data from these marketing emails such as open and click-through-rates to help us improve our service to you.
You can opt out of marketing communications and updates at any time by clicking the 'unsubscribe’ button at the bottom of any marketing e-mail you receive.
When you contact us via email or social media we will store your emails and our replies to you. We will store your emails for two years, unless they relate to a financial transaction such as an order from our Site or Store, in which case they may be held for six years.


- CCTV FOOTAGE (IN STORE)
CCTV monitors our gift shop and gallery at our Store 24 hours a day and records images of individuals in the Store continuously (“CCTV Footage”). Camera locations are chosen to
minimise the capture of images which are not relevant to the legitimate purposes of the monitoring. Surveillance systems are not used to record sound. Images are monitored by authorised personnel during working hours only. No surveillance cameras are placed in areas where there is an expectation of privacy. We do not carry out covert monitoring or surveillance (that is, where you are unaware that the monitoring or surveillance is taking place).
When we talk about “Personal Information” in this Privacy Policy, we are talking about Device Information, Order Information, Marketing Information and CCTV Footage.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We use this information to make your shopping experience as easy and enjoyable as possible.
We use the Order Information that we collect generally to fulfill any orders placed through the Site or Store (including processing your payment information, arranging for shipping, and providing you with invoices and/or order confirmations).
Additionally, we use this Order Information to:
- Communicate with you;
- Screen our orders for potential risk or fraud; and
- When in line with the preferences you have shared with us, provide you with information or advertising relating to our products or services.
We use the Device Information that we collect to help us screen for potential risk and fraud (in particular, your IP address), and more generally to improve and optimize our Site (for example, by generating analytics about how our customers browse and interact with the Site, and to assess the success of our marketing and advertising campaigns).
We use CCTV Footage and images of individuals to prevent crime and protect artworks from damage, vandalism and other crime. The data is used to act as a deterrent against crime, and to support law enforcement bodies in the prevention, detection and prosecution of crime. It also assists in day-to-day management, including ensuring the health and safety of staff and visitors.

SHARING YOUR PERSONAL INFORMATION
We share your Personal Information with third parties to help us use your Personal Information, as described above. For eample:

We also share your relvant information with delivery companies such as Royal Mail and Parcelforce for the purposes of fulfilling and shipping your order.
Finally, we may also share your Personal Information, including CCTV footage to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
Please note that "third parties" are only ever service providers used to help run our business, such as Google Analytics, Shopify and Royal Mail. Your data is never "sold" to anyone for our gain, or passed on for any third party to use for their own marketing purposes.

BEHAVIOURAL ADVERTISING

As described above, we use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you. We do not control these third-party websites and therefore do not accept any responsibility or liability for them. It is your responsibility to check their privacy policies or statements before you submit any personal data to these websites.

YOUR RIGHTS
If you are a European resident, you have the right to access personal information we hold about you and to ask that your personal information be corrected, updated, or deleted. In the first instance we can provide a copy of your information free of charge and will respond within one month of your request (subject to extensions in some cases where requests are complex or numerous).
If we are approached by a third party that you have employed to request your data, we will contact you directly on the email address you have provided via newsletter sign up or when placing an order to confirm the validity of the request and the data requested will be sent directly to this
email address only.
Additionally, if you are a European resident we note that we are processing your information in order to fulfill contracts we might have with you (for example if you make an order through the Site), or otherwise to pursue our legitimate business interests listed above. Additionally, please note that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION

We will keep your Personal Information only for so long as is necessary to achieve the purpose for which we have collected that data, or as required by law, or as required for in order to meet any legal, accounting, or reporting requirements.
The law requires us to keep information about our customers (including their contact details, details of their identity, financial information and information about transactions with them) for six years after they cease being customers.
Information that is no longer needed will be securely deleted.

CHANGES
We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons.
